Notice: Cdesigns Print is a website operated by Cdesigns Marketing. Throughout the site, the terms “we,” “us,” and “our” refer to Cdesigns Marketing. Cdesigns Marketing offers this website, including all information, tools, and services, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

Please read these terms of service carefully. By visiting this website or ordering from us, you engage in our “service” and you agree to be bound by our terms of service. If you do not agree to the terms of service, please do not access this website or place an order. If these terms of service are considered an offer, acceptance is expressly limited to these terms of service. Cdesigns Marketing reserves the right to change, modify, and amend these terms of service without any notice.

ONLINE STORE TERMS

By agreeing to these terms of service, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority in your state of residence, and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the service, violate any laws in your jurisdiction, including but not limited to copyright laws. You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the terms of service will result in immediate termination of your services.

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (NOT including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is ALWAYS encrypted during transfer over networks. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these terms.

All material and software on this website is copyrighted. All rights are reserved worldwide. It is strictly prohibited to redistribute, copy, or republish any of the material or software contained on the Cdesigns Marketing website or the copyrighted property of parties from whom Cdesigns Marketing has licensed such property.

PRODUCTS AND SERVICES

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.

MODIFICATION TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the service.

ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, there may be information on our site or in the service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information in the service or on any related website, including without limitation, pricing information, except as required by law.

ACCURACY OF BILLING AND ACCOUNT INFORMATION & WEBSITE PASSWORD

At our sole discretion, we reserve the right to refuse any order you place with us.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You agree that you are responsible for protecting your password and controlling access to your registered account. You agree that you will be responsible for all orders placed or other actions that are taken through your registered account.

OPTIONAL TOOLS

We may provide you with access to third party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind, and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

THIRD-PARTY LINKS

Certain content, products, and services available via our service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.

ORDER INITIATION & APPROVAL

Browse our products, choose your options, and add the product(s) to your shopping cart. When you’re ready to check out, click on the shopping cart icon at the top right of the page. If you’re a first-time customer, you will be prompted to register for a free customer account with cdesignsprint.com. After you register, you’ll receive an email asking you to verify your email address. Once you have an account, log in with your email address and password, and continue to check out.

If you requested graphic design, a designer will contact you, usually on the same or next business day after you place your order. Your designer will discuss your ideas, what you want your item to say, and whether you want to use photographs of your own or stock images (up to 5 stock images are included with free graphic design). Your designer will then get to work creating a professional layout for you. A proof (digital graphic) of your design will be emailed to you for review. You can communicate revisions to your designer until you are fully satisfied. Once you approve a final proof, the order will proceed to print.

Cdesigns Marketing is not liable for errors after you have approved your design proofs, including, but not limited to, errors in spelling, grammar, punctuation, damaged fonts, incorrect or missing folds, or finished product size. Once a proof is approved by you, we cannot stop the order and cannot issue a refund.

CUSTOMER SUBMITTED ARTWORK AND GRAPHICS

If you will be sending us print-ready artwork, such as logos and images, they must be provided in CYMK color mode with a minimum of 350 DPI. Print-ready files must be one of the following: AI, BMP, EPS, GIF, JPG, PDF, PNG, PSD, TIF, or TIFF.

Your file will need a blue safety line, a pink trim line, and a black bleed line. If your file doesn’t contain these marks, it is not print-ready.

Files must be flattened and fonts must be outlined.

For AI files, images must be properly linked or embedded.

Cdesigns Marketing is not responsible for fuzzy, distorted, or pixilated images resulting from poor quality, customer-provided artwork.

COLOR PROOFING, MATCHING & PRINTING

Cdesigns Marketing is not liable for precise color matching or ink density between digital proofs and the final printed products. The digital proof we send you will predict your design layout, including image and text size and placement, but it will not guarantee a precise color match or ink density between your digital proof and the printed products. Our low-cost methods of printing, and factors such as the application of gloss coatings and other factors can create color variances within lots and from lot to lot. We strive for a color match, but we cannot guarantee the final appearance of a color. Color and density variations can be as much as 15%.

When ordering products, strive to order them in similar quantities to avoid them being run on different presses where a color variance may be more likely to occur.

Be aware that some shifting can occur during the cutting process which can cause the finished product to appear slightly off-center. For this reason, it is best to avoid designs that have a border.

RESTRICTIONS ON CONTENT

Cdesigns Marketing will not print any material that is copyrighted, unless you have obtained express written permission or licenses to reproduce the material. By acknowledging our terms of service at checkout, you agree that you have permission to reproduce any materials you provide to us for use in your designs.

We will not print any material we deem to include hate speech or that promotes discrimination.

We will not print any material we deem to be sexually explicit, obscene, violent, harmful, false, misleading, or unlawful.

We reserve the right to refuse and refund any project without explanation.

FREE GRAPHIC DESIGN & DESIGN FILES

Where free graphic design is offered, it includes an initial design consultation, up to 5 stock images from our image library, high-resolution images of your own you may wish us to include, full layout with custom graphic elements, images, text, and reasonable revisions as necessary to achieve your full satisfaction.

Free graphic design does not include custom illustrations and technical drawings. These can be done for an additional cost. Contact us to request a quote.

Cdesigns will store your graphic design files for you, to make reordering easy. If you need to make minor changes to your graphic files before ordering a reprint, we will implement them at no additional charge.

If you pay a fee for graphic design services, we will provide your graphic design artwork files to you upon request.

In instances where we provide free graphic design, Cdesigns retains ownership of the design files it creates for you and does not release the files upon request unless you wish to pay our regular design fee to purchase your design file.

HOW LONG WILL IT TAKE TO GET MY ORDER?

Your order will ship as soon as your payment has been received and print production is complete. For planning purposes, account for graphic design time (if applicable), print production time, and shipping time outlined below. Order well ahead of the time you need your materials, so you don't find yourself in a crunch.

1) GRAPHIC DESIGN TIME (if applicable) - After the initial design consultation, we will email a design proof within 1-5 business days for most projects. Delays in reaching you for the initial consultation, delays in your responses to our proof(s), revisions, and large or complex projects can extend the time range.

2) PRODUCTION TIME – Print production will begin as soon as you email us approval of your final design proof(s). Most products can be produced in 2-8 business days. A few products require more time. Unforeseen shortages in labor and availability of materials can sometimes extend this range.

3) SHIPPING TIME – Shipping time is the length of time it takes the shipping carrier to deliver your package(s) after your order has been printed. We offer 4 methods of shipping:

A) Express (1-2 business days)

B) Standard (3-7 business days)

C) Economy (8-14 business days)

D) Freight (varies)

Not all shipping methods are available for all products. Shipping times are estimates - NOT guarantees. They vary based on the order destination and the shipping method you choose. The day after your order has been shipped is the first day of shipping.

You will receive an email notification when your order ships. This email will include a tracking number(s) so you can track the delivery progress of your package(s) with the shipping carrier.

NOTE that holidays will extend order turnaround times.

Cdesigns Marketing always strives to deliver orders as soon as possible. In no case shall Cdesigns Marketing be liable for any consequential or other damages resulting from any delay in shipment or delivery.

You agree not to hold Cdesigns Marketing liable for delays in shipment(s) caused by weather, shipping company delays, international customs issues or any other circumstances beyond its direct control.

In the event of unexpected equipment failure, malfunction and or technical problems that delay the printing process, rush charges/fees will be refunded or waived where applicable.

While some items you order may be shipped together, the nature of gang-run printing is that each item you order may be completed at separate times. Each of your items will ship as soon as they are ready.

For large volume, palleted print orders, we will provide a custom shipping quote. Often there is a savings if you have a shipping dock and forklift available.

SHIPPING ERRORS & LOST PACKAGES

Cdesigns Marketing can file a claim for lost or damaged orders, but only if the order is $50.00 or more in value and it has been 30 days or less since the package shipped. Cdesigns Marketing is not responsible for 3rd party shipping errors, omissions or damaged shipments.

CUSTOMER SUPPLIED INCORRECT ADDRESS

When a package is not delivered due to an error made by the customer in submitting the proper shipping address, Cdesigns Marketing will reship the package with corrected address and charge an additional shipping fee for the shipment.

ORDER CANCELLATION

For print-only orders, if you have not yet approved a proof, Cdesigns Marketing can help you cancel your print order. For orders involving graphic design, we can only cancel your order if graphic design work on your project has not yet commenced. Please email theteam@cdesignsmarketing.com if you wish to cancel an order.

RETURNS AND REFUNDS

Since each custom order is unique to our customers and has no resale value, all sales are final. If we verify that we made an error, we will reprint the order. We do not issue refunds or credits.

Customer must notify Cdesigns Marketing of any defects discovered in the ordered product within 2 business days of order delivery. In order to receive replacement, customer must return 100% of the received product within 14 days from the date it was delivered. All orders that are being returned must be shipped at customer's own expense.

DISCLAIMER OF LIABILITY

You expressly agree that your use, or inability to use, the service is at your sole risk. We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. In no event shall Cdesigns Marketing or its licensors, suppliers, or vendors, their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not Cdesigns Marketing has been advised of possibility of the damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from Cdesigns Marketing or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall Cdesigns Marketing be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the site or its content.

INDEMNIFICATION

You warrant that everything you provide to Cdesigns Marketing to be included in your projects is legally owned by you or licensed to you. If the materials, including but not limited to trademarks, images, text, and logos are the property of any third parties, customer warrants that it has secured written permission from those third parties for Cdesigns Marketing to use and reproduce the material for your project. Customer agrees to indemnify, defend and hold Cdesigns Marketing harmless from any and all claims brought by any third party, including, but not limited to, any and all demands, liabilities, losses, reasonable associated costs and claims including reasonable attorney’s fees arising out of injury caused by proprietary material supplied by customer to Cdesigns Marketing, copyright infringement, and defective products sold as a result of customer’s distribution of the project.

You expressly agree to indemnify, defend, and hold Cdesigns Marketing harmless from any and all claims brought by any third party, including, but not limited to, any and all demands, liabilities, losses, reasonable associated costs and claims including reasonable attorney’s fees arising out of injury caused by the display or distribution of customer-approved designs, including any advertising copy Cdesigns Marketing creates for customer.

You expressly agree to indemnify, defend, and hold Cdesigns Marketing harmless against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to a breach of these terms of service.

SEVERABILITY

In the event that any provision of these terms of service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these terms of service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These terms of service are effective unless and until terminated by either you or us. You may terminate these terms of service at any time by notifying us that you no longer wish to use our services, or when you cease using our site. If in our sole judgement, you fail, or we suspect that you have failed to comply with any term or provision of these terms of service, we also may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our services (or any part thereof).

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these terms of service shall not constitute a waiver of such right or provision. These terms of service and any policies or operating rules posted by us on this site or in respect to the service constitutes the entire agreement and understanding between you and us and governs your use of the service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including but not limited to, any prior versions of the terms of service). Any ambiguities in the interpretation of these terms of service shall not be construed against the drafting party.

GOVERNING LAW

Cdesigns Print is a website owned by Cdesigns Marketing, based in Tucson, Arizona. Any legal action or proceeding relating to or arising from your access to or use of this site shall be instituted in Tucson, Arizona. You agree to submit to the jurisdiction of Tucson, Arizona courts and agree that venue in these courts is proper in any such legal action or proceeding.

CHANGES TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, change, or replace any part of these terms of service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the service following the posting of any changes to these terms of service constitutes acceptance of those changes.
